Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Earth Coffeehouse website, mobile application, and related services (collectively, the "Services") operated by TolHouse Summit, LLC ("Earth," "we," "us," or "our"). By creating an account or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

Account Registration

To access certain features, you must create an account. You must be at least 13 years of age to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Earth Wallet

The Earth Wallet allows you to load prepaid funds for use on purchases through our app. By using the Earth Wallet, you agree to the following:

• Non-refundable — Once funds are loaded into your Earth Wallet, they are non-refundable and cannot be withdrawn as cash or transferred to another account.
• No expiration — Wallet balances do not expire as long as your account remains active.
• Usage — Wallet funds can be used for any in-app purchase, including food, drinks, merchandise, and event tickets.
• Loyalty benefit — Purchases made with your Earth Wallet earn 2x loyalty points compared to standard payment methods.

In the event of account termination, any remaining wallet balance may be forfeited. We reserve the right to modify the Earth Wallet program with reasonable notice to users.

Ordering & Payments

When you place an order through our Services, you agree to pay all charges associated with your order. Food and drink payments are processed by Square, and merchandise and event ticket payments are processed by Stripe. We do not store your payment card information. All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to refuse or cancel any order for any reason, including errors in pricing or product information.

Loyalty Program

Earth Coffeehouse offers a loyalty program that rewards you for your patronage. By participating, you agree to the following:

• Points — You earn loyalty points on qualifying purchases. The rate at which points are earned may vary by payment method and promotional offers.
• Tiers — Your loyalty tier is determined by your activity and engagement. Higher tiers unlock additional benefits and rewards.
• Badges — You may earn badges for achievements such as check-ins, order milestones, and community participation.
• No cash value — Loyalty points, tiers, and badges have no monetary or cash value and cannot be sold, transferred, or exchanged for currency.

We reserve the right to modify, suspend, or discontinue the loyalty program at any time with reasonable notice.

Community Guidelines

Our community features allow you to share posts, photos, and interact with other users. By using these features, you agree to the following:

Content Moderation

All community posts are subject to moderation. We use a combination of automated filtering and human review to maintain a positive and respectful environment. Content that violates our guidelines may be removed without notice.

Prohibited Content

You may not post content that:

• Is hateful, threatening, harassing, or discriminatory
• Contains explicit or sexually suggestive material
• Promotes violence or illegal activity
• Contains spam, advertisements, or unsolicited promotions
• Infringes on the intellectual property rights of others
• Contains personal or private information of others without their consent
• Is misleading, fraudulent, or deceptive

Repeated violations may result in temporary or permanent suspension of your account and community privileges.

Intellectual Property

All content, trademarks, logos, and intellectual property associated with Earth Coffeehouse, including the Earth and ECHO brands, are owned by TolHouse Summit, LLC. You may not use, reproduce, or distribute our intellectual property without prior written consent.

By posting content through our community features, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content in connection with our Services. You retain ownership of the content you create.

Limitation of Liability

To the fullest extent permitted by applicable law, Earth Coffeehouse and TolHouse Summit, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our Services. Our total liability to you for any claim arising from your use of the Services shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim. Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied.

Indemnification

You agree to indemnify, defend, and hold harmless Earth Coffeehouse, TolHouse Summit, LLC, and their officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or engage in conduct that we determine is harmful to our community or business. You may request account deletion at any time by contacting us at [email protected]. Upon termination, your right to use the Services will immediately cease, and any remaining wallet balance may be forfeited.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Lucas County, Ohio.

Dispute Resolution

Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at [email protected]. We will make a good-faith effort to resolve the matter within 30 days. If informal resolution is unsuccessful, either party may pursue formal legal remedies in accordance with the Governing Law section above.
